DMCA at a glance

  • What this covers: claims that content on inkhug.shop, or a product printed by Ink Hug, infringes a copyright.
  • Where to send notices: support@inkhug.shop, subject “Copyright notice”.
  • What we do: review complete notices, remove or disable the material where appropriate, and tell the person affected.
  • Counter-notices: if your content was removed by mistake, you can send a counter-notice.
  • Repeat infringers: accounts that repeatedly infringe may be closed.

Ink Hug respects the rights of photographers, artists, designers and every other creator. We expect our customers to do the same. This page explains how to tell us about a copyright problem under the United States Digital Millennium Copyright Act (DMCA), what we do when we receive a notice, and how someone whose content was removed can respond. It sits alongside our Intellectual Property Policy, which covers trademarks and the rules for personalization content more broadly.

1. Why this matters for a personalized gift shop

Most of what we print comes from our customers: family photos, pet portraits, names and short messages. Customers confirm when they order that they have the right to use what they send. Occasionally, though, a customer sends something they do not own, such as a photo taken by a professional photographer without permission, a drawing found online, or an image of a character or team logo. Our own website also contains text and images, and we want to know if anything there uses someone else’s work without permission. The process below lets rights holders tell us quickly and lets us respond fairly.

2. Where to send a notice

Send copyright notices by email to support@inkhug.shop with the subject “Copyright notice”. You may also send a notice by post to:

Ink Hug, Attn: Copyright Notices, 5498 W Pulley Lane, Herriman, UT 84096, US.

Email is faster and lets you attach evidence. We acknowledge notices within 24 hours on business days.

3. What a valid notice must include

To be effective under the DMCA, your notice must include all of the following:

  1. Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner.
  2. Identification of the copyrighted work you believe has been infringed. If several works are covered by one notice, a representative list.
  3. Identification of the material you believe is infringing, with enough information for us to find it: the full URL of the page on inkhug.shop, or, for a product we printed, the details you have, such as a photo of the item and where you saw it.
  4. Your contact information: name, postal address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner’s behalf.

Incomplete notices slow everything down. If something is missing, we will tell you what we need. Please do not send notices about trademarks, privacy or other issues under this process; see our Intellectual Property Policy and Privacy Policy instead.

4. What we do when we receive a notice

How a copyright notice is handled
StepWhat happens
1. AcknowledgeWe confirm receipt within 24 hours on business days
2. ReviewWe check the notice is complete and locate the material
3. ActWhere the notice is valid, we remove or disable access to the material on our site, or stop printing the content
4. NotifyWe tell the person who provided the material, such as the customer who sent a photo, and give them a copy of the notice with personal contact details removed where appropriate
5. RecordWe keep a record of the notice and our action, including for repeat-infringer purposes

If the notice concerns an order that has not been printed yet, we will pause it and contact the customer. If the item has already been delivered, we cannot recall it, but we will not print that content again and will tell the customer about the notice.

5. Counter-notices

If material you provided was removed and you believe that happened because of a mistake or misidentification, you can send a counter-notice to the same address. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal, or the order it relates to.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, any judicial district in which Ink Hug may be found, and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we forward it to the person who sent the original notice. If they do not tell us within the period set by the DMCA that they have filed a court action, we may restore the material or resume the order.

6. Repeat infringers

We may close the accounts of, and refuse future orders from, customers who repeatedly send content that infringes others’ copyrights, where we have received valid notices about them. We decide case by case and take into account mistakes and successful counter-notices.

7. Misleading notices

Under the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and attorney’s fees. Please make sure your claim is accurate before sending it. If you are unsure whether a use infringes your rights, you may wish to seek legal advice first.

8. Our rules for customers’ content

Customers can help us avoid copyright problems from the start. When you personalize an order in the checkout order notes or send a photo by email, please only use:

  • photos you took yourself, or photos of family and friends that you are allowed to use for a personal gift;
  • professional photos, such as wedding or school portraits, only where your photographer’s license allows personal reproduction;
  • your own drawings, handwriting or children’s artwork;
  • names, dates and words you wrote, not song lyrics, poems or quotes you do not have the rights to print.

We will not print team logos, brand marks, cartoon or film characters, celebrity photos, or artwork copied from the internet. If an order contains such content, we may cancel it and refund it in full. Our Terms of Service explain this in section 4.

Professional photos

Wedding, newborn and family portraits are often taken by professional photographers who keep the copyright. Many photographers give clients a print release that allows personal printing; some do not. If you are using a professional photo, check your release or ask your photographer. You do not need to send us the release, but by ordering you confirm you have permission.

9. Fair use and personal gifts

People sometimes ask whether printing a picture for a single personal gift is allowed because it is “not commercial”. The answer depends on the facts, and a gift printed by a business for payment is still a commercial reproduction. That is why we ask for permission rather than relying on fair use. If you are not sure whether you may use a picture, choose a photo you took yourself, or ask the person who took it. Your own family photos, pet photos and handwriting are always the simplest and most personal choice.

Handwriting and children’s artwork

A child’s drawing or a loved one’s handwritten note is one of the most meaningful things to print on a pillow. If the drawing or note was made by someone in your family, you can usually use it for a family gift. Photograph it flat in daylight and send it with your order number, as described on our FAQs page.

10. Content on our own website

The text, layout, logo and images on inkhug.shop were created for Ink Hug or are used with permission. If you believe something on our site uses your work without permission, send a notice as described above and include the URL of the page. We take this seriously and will review it promptly. If you would like to use Ink Hug content, such as a photo or a passage of text, please ask us first by email.

11. Privacy of notices

We may share a copy of a notice with the customer whose content it concerns, so they can understand and respond. Where appropriate, we remove personal contact details before forwarding. We may also share notices with legal advisers or authorities where the law requires. We handle the information in notices under our Privacy Policy.

12. Examples

  • A photographer finds their portrait on a pillow. They send a complete notice with a photo of the item. We stop printing that photo, tell the customer who ordered it, and record the notice.
  • A customer’s order uses a cartoon character. We spot it before printing and cancel the order with a full refund, explaining why. No notice is needed.
  • An illustrator sees their drawing in a product example on our site. They send the page URL. We remove the image while we check where it came from, and reply to them.
  • A customer’s family photo is removed by mistake. The customer sends a counter-notice confirming they took the photo. We forward it to the person who complained and, if no court action follows, resume the order.

13. Timing and communication

All copyright communication happens by email so there is a written record. We reply within 24 hours on business days. Complex notices may take longer to resolve, but we will keep you informed at each step. If you send a notice by post, include an email address so we can reply quickly.
